The Court of Appeal has withdrawn Justice Orieno Odek from hearing a petition filed by gubernatorial aspirant following allegations of bias. Karua’s appeal seeks to challenge the high court’s ruling that dismissed her first petition against Kirinyaga governor Anne Waiguru.
Narc-kenya leader Martha Karua doesn’t seem to back down on the Kirinyanga county aspirations. After losing her petition that disputed the election of Governor Anne Waiguru, Karua is still pushing for hearing and is now accusing one of the judges in her second appeal to be bias and wants him dismissed from the case. Karua cited the claims through her lawyer Gitobu Imanyara prompting the presiding judge Mohammed Warsame to further direct Waiguru’s lawyers and the IEBC to submit their replies. It was later decided that a new bench will be formulated without Justice Odek.
The former Justice and Constitutional Minister faced a blow after losing her first petition and further capping a Kshs 10 million cost. Elsewhere, Nairobi Governor Mike Sonko is a worried man following an appeal filed by an ODM official seeking to resuscitate the petition challenging his election. However Governor Sonko in his defence says the grounds for the appeal are similar to the ones dismissed by Justice Mbogholi last month. Justice Mbogholi in his judgement said that the petitioners were no longer interested in pursuing the case however, the judges will hear the fresh applications after submission by parties on March 13th.
